CollectIT is trying to improve the court process around liquidation
In
CollectIT's February 2011 newsletter we wrote about a diy subscriber's
frustration at the High Court's refusal to allow it, as a company, to
file liquidation documents against a debtor. CollectIT's subscriber had
no choice but to engage a solicitor, and pay a fee to that solicitor in
return for the solicitors name on the documents.
This situation only
occurs in the High Court. In the District Court a company is permitted
to file documents and appear in court through an appropriate company
representative, for example, a company director. CollectIT wrote to the
Minister of Justice pointing out the differences between the District
and High Court and asking whether there were any plans to change this
situation and allow company representatives to file documents and appear
in the High Court on a company's behalf.
The Ministry for Courts
responded on 7 April 2011 and basically the response was disappointing.
Not only are there no plans to change the current situation there is a
suggestion that there may be a change in the future to disallow the
filing of documents, and appearances in court by a company in the
District Court. CollectIT considers that all entities, whether they be
individuals, trusts or companies should be allowed to file documents and
appear in court. No good reason has been put forward for the
distinction between individuals and companies. The current situation in
CollectIT's view amounts to a barrier in the High Court process to justice.
So
.... we need to work within the courts rules at the moment and that is
exactly what CollectIT is doing with fantastic results. If you have
